How Wrongful Death Claims Help Surviving Family Members

The loss of a loved one is devastating and painful for any family to endure. Any sudden death because of an accident caused by another party or entity’s negligence may make it more challenging to come to terms with. When faced with such situations, families may take legal action against the party responsible for their loss through a wrongful death action. In fatal motorcycle accident cases, claims are generally brought against the negligent driver and their insurance company for resulting losses. In situations where the other party has little to no liability coverage, survivors may seek recourse through their loved one’s uninsured and underinsured motorist protection for help supplement or fully cover damages incurred.

Under California law, eligible survivors may seek the recovery of economic and non-economic damages. These may include funeral service costs, expenses for end-of-life care, reasonably expected loss of services and income, mental anguish, and loss of companionship. These serve the purpose of making a family whole again after the wrongful death of a close relative. It may also provide the sense of justice survivors need knowing that the other party has been held accountable for the harm their actions have caused. The ability to hold an at-fault party liable for the loss of a family member and the amount of compensation sought through a wrongful death claim will depend on the facts and circumstances of the case.

Keep in mind that a wrongful death case must be filed in civil court no later than two years from the date of the fatal incident as outlined in the California Code of Civil Procedure Section 335.1. The filing deadline may be shortened to as little as six months in a case involving a government entity. Because of these strict filing criteria and time limits, it is essential to reach out to an experienced accident attorney right away to discuss your rights and options for recovery as a surviving family member.
