Hard Closure on I-580 Shuts Down Eastbound Lanes
About 800 yards ahead of where the fatal motorcycle crash happened, a black company truck was stopped on the right-hand side of the highway. Caltrans was notified of a hard closure of the eastbound lanes of I-580, and a SigAlert was issued due to the traffic collision. The motorcycle was towed from the scene. Information was not provided on whether the vehicle that was located was responsible for the motorcyclist’s demise. The CHP traffic accident unit is investigating the cause of the crash.
A Lawyer’s Role in Investigating a Fatal Motorcycle Crash
A lawyer takes on the responsibility of investigating and pinpointing the cause of a fatal motorcycle crash, aiming to secure wrongful death compensation for the deceased’s family. Here’s how they actively approach the case:
- Collecting evidence: The lawyer gathers all evidence, including police reports, scene photos, witness statements, and medical records, right away.
- Evidence analysis: The lawyer analyzes the collected evidence to identify the crash’s cause, focusing on potential factors like road conditions, vehicle defects, or driver negligence.
- Witness interviews: Directly interviewing witnesses, the lawyer seeks insights into the crash’s dynamics.
- Collaborating with accident reconstruction experts: In complex cases, the lawyer may collaborate with an accident reconstruction expert, who then reviews the evidence and recreates the crash scene to clarify what happened.
With a thorough investigation, the lawyer strategizes the most effective way to advance the claim, choosing between filing an insurance claim or pursuing legal action against those at fault.
Compensation in Motorcycle Accident Fatalities
For those pursuing a wrongful death claim after a motorcycle accident, the law presents two pathways, open to estate administrators or the immediate family, which includes spouses, putative spouses, children, or, in their absence, parents and siblings. However, only one consolidated claim is permissible. Possible compensation includes:
- Funeral and burial costs
- Recovery of the deceased’s potential earnings up until retirement, along with usual benefits and bonuses
- Spouses may claim loss of consortium
- Children can seek compensation for the loss of guidance and nurturing
- The family might recover costs for household services rendered by the deceased
By actively engaging in these steps, a lawyer not only aims to establish fault but also ensures the deceased’s family receives rightful compensation for their loss.
