What Surviving Family Members Should Know About Wrongful Death Cases in California
When a loved one passes away from a preventable motorcycle accident, surviving family members are often left behind to deal with the consequences and pick up the pieces. In this sense, a wrongful death claim may exist to allow survivors to offset the emotional and financial impact of a close relative’s death caused by someone else’s negligence. Compensation in these types of cases is divided into economic and non-economic damages. These may include intangible and financial losses like medical and funeral expenses for the decedent, loss of services or future financial support, lost companionship, mental anguish, and more.
A wide array of factors may come into play for an insurance settlement or a jury award in a wrongful death case. A jury may consider factors such as the decedent’s age, health, education, occupation, anticipated earning potential, and more. Conversely, the loss of a loved one may qualify survivors for other types of losses, such as lost parental guidance and care. While it may be challenging to understand the true extent of compensatory damages, an experienced Brentwood wrongful death lawyer can help. Receiving fair compensation in a civil case requires following strict filing criteria and deadlines that apply.
Under the California Code of Civil Procedure Section 335.1, the statute of limitations for a lawsuit arising from a wrongful death motorcycle accident is two years. Conversely, if the incident was the result of negligence on the part of a government entity for a road defect, a notice of claim must be filed within six months of the accident date. This is by the California Government Code Section 911.2. Starting a wrongful death case requires substantial time for an independent investigation, collection of evidence, interviewing witnesses, and more. This is especially true if an auto products liability claim is being brought if faulty parts or equipment are believed to have caused a fatal solo motorcycle crash.
