Things Families Should Know About Fatal Motorcycle Crashes and Wrongful Death Cases
The loss of a close relative is extremely trying and challenging to cope with, particularly if it occurred because of someone else’s negligence. When a loved one loses their life in a motorcycle crash or another type of accident caused by another party or entity, surviving family members may have grounds for a wrongful death action. This type of case seeks financial compensation for losses to make a family whole again. While no amount of money can undo the pain and devastation, it may provide a sense of justice knowing that the other side has been held financially accountable for their negligent actions.
Remember that there is a time limit on wrongful death cases in California. This means that there is a limited amount of time to file a case in civil court if a mutual settlement agreement is not reached within that period. To protect the statute of limitations, a lawsuit for wrongful death must be filed no later than two years from the date of loss. Failing to protect the statute may result in the court dismissing the case and the loss of the opportunity to seek financial compensation from the at-fault party.
