Highway 48 Fatal Pedestrian Accident With Motor Vehicle
A fatal pedestrian accident was reported on an Auburn highway on August 22 when the walker died in a traffic crash. The collision occurred, according to the Auburn Police Department, along Highway 49 between Elm and Palm Avenues around 8:20 p.m. Authorities said the pedestrian wasn’t walking in a crosswalk when the collision occurred.
Driver Remains at Scene of Fatal Pedestrian Accident
The driver of the vehicle that struck the pedestrian remained at the accident scene. Alcohol or drugs are not expected to factor into the cause of the accident. The deceased person’s identity will be released by the Placer County Coroner’s Office once the family has been notified.
Negligence in a Fatal Pedestrian Accident
Far too many pedestrians die in accidents every year around the country. Although the person on foot is negligent in some of them, others are caused by drivers who are speeding, distracted, inebriated or committing some other act that endangers others. When the accident investigation is complete and it is determined that the driver of the vehicle was negligent, that individual or entity may be liable.
A Wrongful Death Claim Can Recover Damages
Wrongful death claims are civil actions filed by surviving family members against the negligent party responsible for their loved one’s death in order to seek compensation. An estate’s personal representative or the deceased’s family can file this kind of lawsuit in California. However, only one lawsuit may be filed.
Families of the deceased may be eligible for compensation such as the following:
- Funeral and burial costs can be recovered.
- Wages that the deceased person would earn until retirement, which includes benefits such as insurance and pension are recoverable.
- The spouse may recover compensation for the loss of consortium, affection and moral support the decedent provided.
- The family’s children may obtain compensation for the loss of their parent’s guidance, nurturing and love.
- In some cases, the loss of inheritance can be recovered.
- Compensation for the loss of the decedent’s help around the home may be recovered. This category refers to areas where the decedent worked at the home, such as mowing the lawn, taking care of the vehicles, cooking and cleaning, childcare and others. The award is made where the surviving spouse has to hire someone to perform those tasks because of the demise of their partner.
