What is Wrongful Death and What is Involved in the Process?
If a close relative’s death was preventable had the other side exercised due care, surviving family members may be entitled to financial compensation through a wrongful death claim. However, the claims process is not always straightforward, given that insurers do not have a grieving family’s best interests at heart. Retaining legal counsel can help level the playing field and protect a family’s rights throughout the process. Remember that there is strict filing criterion and deadlines involved in these cases. Therefore, it is essential to act quickly before it is too late.
A wrongful death lawsuit must be filed within two years of the date of loss per CCP 335.1. However, this may differ based on the facts and circumstances of the fatal pedestrian accident case. For instance, a six-month statute of limitations applies to cases involving public agencies, according to the California Government Code Section 911.2. Therefore, a case must be filed within the applicable deadline, or it will not be heard by the court on the grounds of failing to protect the statute.
According to CCP 377.60, there is a specific set and order of family members who have grounds to file a case. This includes the decedent’s surviving spouse, children, or domestic partner. If there are no children, domestic partner, or spouse, the deceased’s surviving parents, stepchildren, and other relatives who depended on them for financial support may have grounds for a claim. An experienced wrongful death attorney can help survivors by determining their eligibility for a case. Recovery Options for Fatal Pedestrian Accident Cases
The loss of a close relative may leave surviving family members in emotional and financial hardship. Matters may be worsened if it is determined that the at-fault party has little to no liability coverage. In these situations, an uninsured or underinsured motorist coverage claim through the decedent’s auto insurance policy may be appropriate. Conversely, the family of the deceased may bring a claim through their UM and UIM coverage if the deceased did not have an insurance plan at the time of the incident.
