What is Wrongful Death?
Wrongful death is defined in California as a loss of life caused by the negligence of another party or entity. The purpose of a claim for wrongful death is to hold the other side liable for their actions, deter similar conduct from them in the future, and obtain financial recovery for the resulting losses. Compensation comes in two types in a wrongful death action, including economic and non-economic damages. These may include mental anguish, medical bills for final injuries (which may be recovered through a survival action), funeral service costs, and loss of companionship. Financial recovery may also help make up for the services, benefits, and lost earnings provided by the decedent.
Fatal accident cases may be challenging to navigate as they often involve extensive investigations and strict filing criteria. Most cases are subject to a two-year time limit. This means that a claim must be settled with the other side before that deadline runs out. If that does not occur, the case must be filed in civil court. Moreover, wrongful death cases can only be brought forward by specific surviving family members outlined in CCP 377.60. This generally includes the deceased’s children, spouse, or domestic partner. Some exceptions may apply if these relatives do not exist, and filing eligibility may extend to other family members.
During such a difficult time, seeking justice for a close relative may help ease the grief. This starts with holding the party or entity responsible for the loss accountable through a wrongful death action.
