Fatal Redding Accident Being Investigated by the CHP
A 24-year-old man attempted to cross the road in front of a 2024 Ford Fiesta as it exited the freeway. The vehicle’s front left and windshield struck the pedestrian, inflicting fatal injuries. Shortly after, a 2012 Ford also ran over the man as he lay on the roadway. The Shasta County Coroner’s Office is working to identify the deceased, and CHP traffic crash detectives are investigating the cause of the accident.
Understanding a Wrongful Death Claim in Fatal Highway Accidents
Families may choose to pursue a wrongful death lawsuit when a fatal Redding accident occurs due to someone else’s negligence or wrongful actions. This legal action cannot cure their grief but alleviate potential financial burdens caused by the loss. Moreover, it often gives the family a sense of justice and closure for their tragic experience.
Recoverable Damages in a Highway Collision Wrongful Death Lawsuit
In wrongful death lawsuits related to highway collisions, certain damages can be recovered by eligible family members or an estate representative. Only one claim is pursued on behalf of the deceased, and if there is no spouse or children, other relatives, such as siblings and parents, may file a claim. The recoverable damages include:
- Children may claim losses due to the absence of the deceased’s future care, training, nurturing, and guidance.
- Compensation for medical expenses before the death can be sought through a survival action.
- Families can recover funeral, burial, and cremation expenses.
- Compensation may be sought for the loss of household services like child care, home upkeep, and yard and vehicle maintenance.
- Spouses may seek compensation for consortium losses, including comfort, affection, and emotional support.
- The estate’s beneficiaries may receive damages for the potential loss of inheritance.
- Earnings the deceased pedestrian would have accumulated, including benefits like pensions, insurance, and bonuses, can be part of the compensation.
- Under certain circumstances, families may pursue punitive damages in civil court to punish the responsible party and deter future similar behavior if the actions leading to death were particularly egregious or deliberate.
