Details on the Fatal Rollover Collision on Highway 99 in Madera County

According to CHP traffic officers, a vehicle was traveling north on Highway 99. For unknown reasons, the car veered off the roadway, overturned several times into a field in the area, and caught fire.

The vehicle carried two occupants at the time of the incident, a man and a woman. Sadly, they succumbed to their injuries at the scene. The identities of those involved in the fatal car accident have not yet been identified. Additional information on the crash was not immediately available as investigators are working to determine what caused it.

What You Should Know About Rollover Accidents

All motor vehicles are susceptible to rollover collisions. However, most of these types of accidents occur in light pickup trucks, passenger vans, and SUVs. This is partly because of the high center of gravity these vehicles have. Conversely, these vehicles may also be susceptible to a rollover when they are carrying a load in which has made them top-heavy. The reason why rollovers are especially dangerous compared to other types of crashes is that there are tremendous forces applied to the roof of the vehicle, causing it to crush inward.

As we may all expect, our vehicles should meet federal guidelines on crashworthiness to protect us from harm’s way and serious injury in a car accident. Automakers have a duty to design and manufacture vehicles that consider evolving technology in terms of safety and design. In the case of a rollover accident, it must be shown that the car in question has failed to meet Federal Motor Vehicle Safety Standard 216 on roof crush resistance and that this defect contributed to the injuries or death suffered by the driver and passengers.

A skilled injury attorney may establish that a fault in the design or manufacturing of a motor vehicle may have contributed to an accident or possibly exacerbated the injuries sustained in the incident. This may be done through an auto products liability claim. Keep in mind that the vehicle must be kept and preserved for an attorney and their team of experts to evaluate for possible defects. How a Lawyer Can Help Your Family with Your Wrongful Death Case

People in Madera and across California suffer injuries in accidents every day. The unfortunate reality is that some of these injuries may prove fatal in some extreme cases. When a loved one has lost their life because of someone else’s negligence, the surviving family member may bring a wrongful death claim in Madera County for financial recovery from the responsible party.

The types of damages survivors may seek are categorized into economic and non-economic losses. Economic damages represent financial losses, whereas non-economic damages are those losses that are intangible in nature. Some of the types of damages families may recover include funeral expenses, medical bills, loss of future financial support from the decedent, mental anguish, loss of companionship, and more.

A wrongful death action may be challenging and filled with emotional distress, frustration, several parties, evidentiary issues, and disputes regarding the proximate cause of death. However, no family should have to endure the consequences of a loss of a loved one nor the legal process alone. If your family is considering taking legal action, do not delay as these cases are generally subject to a two-year statute of limitations. To determine whether you have the grounds to seek compensation on behalf of your loved one, contact an experienced wrongful death attorney at our law firm today.
