Fatal Rollover Crash Reported in Merced County

Details on the Merced County Fatal Rollover Crash
A spokesman with the CHP Merced area office reported that three minors, two of which from Kern County, were involved in the rollover accident. A 17-year-old Winton resident was behind the wheel of a 2002 Toyota traveling eastbound on Turlock Road. For unknown reasons, the Toyota driver allegedly veered into the oncoming traffic lane, off the roadway, and overcorrected to the right. The movement reportedly caused the car to overturn, CHP traffic officials reported.
The front passenger suffered injuries described as minor. The rear passenger did not report injuries but was transported to the hospital as a precaution. Sadly, the Toyota driver succumbed to their injuries at the scene. A GoFundMe page has been established on behalf of the Winton resident and their family to help cover final resting expenses.
Wrongful Death Claims for Fatal Car Accidents
When a loved one has lost their life in a motor vehicle collision, the family they leave behind will want to know what happened and who is at fault. While a wrongful death action may not be the first thing on the minds of surviving family members, it is essential for them to take specific steps after fatal crashes. Such cases serve the purpose of allowing families to seek justice by holding at-fault parties liable for their actions. They also send strong messages to others in the community that such behavior will not be tolerated.
The unfortunate reality is that insurance companies do not make it easy for surviving family members to recover compensation through the claims process. Insurers may attempt to take advantage of survivors, even in their time of loss and grief. The better families understand wrongful death laws in California, the more they will be able to protect their rights and best interests.
A wrongful death lawsuit in California is subject to a statute of limitations, a deadline that surviving family members will need to follow to file the case. If it is not met, the court may dismiss the case, and the family will no longer be able to claim financial recovery for damages incurred. Under the California Code of Civil Procedure Section 335.1, survivors have two years from the date of the fatal incident to bring a claim. Specific factors may shorten or extend the deadline, so it is essential to contact an experienced Merced wrongful death attorney to determine whether they apply to your case. How a Lawyer Can Help After a Fatal Rollover Accident
While a rollover accident may involve any vehicle, some are more susceptible to overturning because of their higher centers of gravity. This may include SUVs, light pickup trucks, and full-size vans. One of the common issues involved in these cases is an exacerbation of accident-related injuries because of the car roof crushing on impact. When a vehicle roof fails to meet federal guidelines on roof crush resistance, as outlined in the Federal Motor Vehicle Safety Standard 216, the automaker may be held liable for damages through an auto products liability claim.
As with any case, the legal process is generally not straightforward. It is often necessary to retain an attorney who can conduct an independent investigation of the rollover to determine how it occurred and which parties should be held liable. The lawyer may also work with expert witnesses to build a strong case for fair compensation.
