Understanding Wrongful Death Claims After an Accident

When an accident leads to the tragic loss of a loved one due to negligence, the family has the right to pursue a wrongful death claim for compensation. Typically, this right extends to the decedent’s immediate family, including their spouse and children, especially after a fatality in Sacramento. Stepchildren who received at least 50 percent financial support from the deceased, as well as the estate’s executor, are also eligible to file. In the absence of immediate family members, parents and siblings of the deceased may file a claim, but only one claim is permitted.

Types of Damages Recoverable in a Wrongful Death Claim

Families may seek compensation under several categories, such as:

  • Lost Income: This includes lost wages, employee benefits such as health insurance and pensions, and projected earnings over the decedent’s expected career duration.
  • Funeral and Burial Costs: Reasonable expenses incurred for the burial or cremation of the deceased.
  • Loss of Companionship: Compensation for the loss of love, affection, and spousal support for those bereaved.
  • Support for Children: Claims may be made for the loss of moral support and guidance that children would have received from their parent.
  • Inheritance Losses: Potential losses that beneficiaries may have claimed from the decedent’s estate or will.
  • Household Chores: Compensation for lost household assistance, including duties like lawn care, gardening, vehicle maintenance, and tax preparation.
