Out-of-Control Fatal Single-Vehicle Accident Occurs Near Cherokee Road

A fatal single-vehicle accident occurred on southbound State Route 99 just north of the Cherokee Road off-ramp in August, CA, northeast of Stockton. An SUV veered off the roadway around 3:30 p.m. and crashed into a fence on the right-hand side, ending up on the other side of the barrier. The California Highway Patrol (CHP) swiftly responded to the scene, along with the local fire department, who were also en route to assist.

Fatal Single-Vehicle Accident Being Investigated to Determine Cause

A tow truck was requested to remove the vehicle from the area. The San Joaquin Sheriff’s Office Coroner was called to declare the driver deceased. The name will not be released until the coroner’s office has notified the deceased person’s family. The CHP traffic collision unit continues to examine the cause of this tragic incident.

Compensation in a Wrongful Death Claim

The amount of compensation awarded in a wrongful death claim varies based on the circumstances of the fatal single-vehicle accident and the damages. Recoverable damages include funeral expenses, pain and suffering, lost wages of the deceased, and loss of consortium and household assistance. Additionally, punitive damages may be awarded to penalize the defendant’s negligent actions if they were intentional or especially egregious. If the deceased survived for a period before passing away, a survival action could be filed to recover medical expenses and compensation for their pain and suffering.

An injury lawyer can significantly ease the burden on a grieving family by handling the legal aspects of the case. This support allows the family to mourn without the added stress of financial concerns following the death. Furthermore, experienced legal counsel can help families achieve closure and ensure justice is served in their loved one’s case.

Eligibility for Filing a Wrongful Death Claim

In the aftermath of a fatal single-vehicle accident, families have the option to pursue a wrongful death claim to seek justice and alleviate financial burdens. Compensation can be sought by immediate family members, including spouses and children. If there are no surviving spouses or children, the parents or siblings of the deceased may also be eligible to file a claim. Additionally, the estate of the deceased may initiate a lawsuit; however, only one wrongful death claim is permitted per incident.
