What Types of Losses are Recoverable in Wrongful Death Car Accident Cases?

Under California law, if an individual suffers fatal injuries in an accident caused by the negligence of another party or entity, then the surviving family members of the deceased may have grounds for a wrongful death claim. Survivors may bring a case forward for their financial hardship in addition to the full value of the decedent’s life. This is generally represented in economic and non-economic damages. This may include mental anguish, loss of companionship, funeral service costs, medical bills, lost earnings, and more.

Damages for lost earnings may be sought in fatal accident cases. This considers the income the deceased would have earned based on their life expectancy. This may include earnings, employment benefits, and other financial support the deceased would have contributed to the family household. A skilled California wrongful death attorney will often work with vocational experts and economists to determine the present value of future wage loss.

Non-economic damages are intangible in nature. They differ in value and should be evaluated on a case-by-case basis. As seen from the family’s perspective, the loss of life means being deprived of the companionship and care they received from the deceased. Conversely, the loss of parental guidance and support for surviving children may also be considered. Therefore, it is best to work with an attorney who knows how to persuasively show defense counsel and a courtroom what a loss of life means.

Who Can File a Claim for Wrongful Death?

Per CCP 377.60, the family members who have priority to file for wrongful death include the children, domestic partner, or spouse. Parents, stepchildren, putative spouse, and the putative spouse’s children may file for wrongful death if the previously mentioned relatives do not exist.
