Nees Avenue Traffic Collision Proves Fatal When Vehicle Crosses Centerline
A fatal traffic collision near Fresno recently claimed the life of one person in Clovis when a vehicle crossed over the centerline and struck a truck. The collision occurred along Nees Avenue between North Sunnyside and North Minnewawa avenues at about 5:30 p.m. It was reported by officers with the California Highway Patrol (CHP) that a Chevy Malibu was traveling east along Nees Avenue at the same time a truck hauling livestock feed was moving west.
Driver Killed When Chevy Crashes with Truck
The Chevy drifted over the centerline, and although the truck driver swerved in an attempt to avoid a collision, the car struck one of the axles. The impact resulted in the truck experiencing a rollover. Although the truck driver was uninjured in the collision, the driver of the Chevy was ejected and passed away at the accident scene. Neither alcohol nor drugs appear to factor into the cause of the accident, according to the CHP.
Loss of a Loved One in a Fatal Traffic Collision
When an accident occurs and a family loses a loved one, they are not only grief-stricken but consumed with wondering why it happened. Although many of these accidents are simply driver error, such as texting, speeding or other causes, outside factors can also result in death.
Help From an Injury Lawyer Can Determine the Cause of a Traffic Collision
An injury lawyer can investigate to determine why the fatal traffic collision occurred. Finding out the real reason cannot only help bring a family a sense of closure but a wrongful death lawsuit can be brought against the negligent party, bringing them justice for their loss. Some of the following types of negligence can lead to a fatal traffic collision:
- Defective auto parts sometimes cause a fatal crash. People have sometimes read stories or heard accounts about brake failure in a vehicle or a driver’s inability to stop or slow down because the accelerator becomes stuck. In addition, if the motor shuts off, the driver loses control because the steering wheel freezes. Any of these problems can cause a fatal traffic collision. Retaining a vehicle following an injury or fatality accident is important, so the car can be examined for defects. If one is found to have led to the collision, the family may file an auto product liability claim against the car manufacturer and others with the help of an injury lawyer. Under California law, a person who suffers an injury due to a defective auto part has up to two years or from the time it becomes known to file a claim before the statute of limitations runs out.
- Government negligence that can lead to a fatal traffic collision includes potholes, bad lighting overhead, overgrown foliage at intersections and others. Our investigators can go to the accident site and examine it for signs of government neglect. If this is found, the family can file a claim to recover damages. However, because the statute of limitations for filing against a government entity is only six months, hiring an injury lawyer to handle the paperwork and ensure the deadlines are met is important.
