What Families Should Know About Fatal Accidents and Wrongful Death Claims

After the loss of a loved one in a sudden accident, surviving family members deserve all the time and assistance they may get. Nothing may ever undo the pain of losing a close relative or bring them back but taking legal action may help ensure survivors are compensated as they work to rebuild their lives. A loss of life is considered wrongful death when it occurs because of the negligence of another party or entity. The purpose of a wrongful death claim is to alleviate the financial hardship that may come with the unexpected loss, but there may also be intangible losses that may be considered as well. With a claim for damages, families may recover the following:

  • Final medical treatment expenses the decedent incurred
  • Costs of funeral and burial services for a lost loved one
  • Lost wages and benefits, including those in the future
  • Loss of care, companionship, and support for survivors
  • Punitive damages may also be available in cases involving egregious actions like DUI or excessive speeding

To bring a claim in California, it is best to work with an attorney who has years of experience handling wrongful death matters. A lawyer may go over the details of the case to determine whether it is valid, ensure all filing deadlines are met, and most importantly, assist in establishing negligence and damages incurred.
