What Families Should Know About Wrongful Death Matters
The unexpected loss of a loved one may bring significant life changes to the family left behind to pick up the pieces. When a close relative has been lost because of the negligence of another party or entity, surviving family members may have grounds for a wrongful death claim. To bring a successful civil case forward, the evidence must prove that the loss of life occurred through the at-fault party’s actions. This may be accomplished through evidence like expert witness testimony, police reports, video surveillance of the crash scene, physical evidence at the site like skid marks on the road, and more.
Economic and non-economic damages may be sought in a wrongful death matter, including costs of medical bills for the final injuries from the incident, funeral service costs, mental anguish, loss of companionship, lost financial support, and more. California law permits certain relatives to file a claim, including the spouse, domestic partner, or children of the decedent. There is also a strict filing deadline that applies. Families have up to two years to file a case in civil court. Given that there is so much that goes into building a fatal big rig crash case, it is essential to consult an experienced Fresno wrongful death lawyer to learn about the unique procedural requirements involved in these matters.
