What is a Wrongful Death Action?

Filing a claim of wrongful death exposes the other side whose carelessness or negligence resulted in losing a loved one. Shining light on the at-fault party’s actions may prevent another wrongful death for another family in the community. Under the wrongful death statute, those with priority for filing include the surviving domestic partner, children, or spouse of the deceased. This is outlined in CCP 377.60. Other relatives may be eligible under specific circumstances. In most cases, the family may receive reimbursement for non-economic and economic damages.

Recoverable losses in cases of wrongful death often include mental anguish, loss of love, companionship, support, and guidance, cost of household services the decedent would have contributed if not for the fatal incident, financial contributions the deceased individual would have made to the family household had they survived, reasonable costs of funeral and burial services, and more. The statute of limitations sets the time limit for these matters at two years, per CCP 335.1. This must be followed closely as the failure to file may cause the family to lose the right to seek damages.
