Filing a Wrongful Death Claim for Compensation
If your loved one’s death resulted from another driver’s negligence or the fault of another party, their spouse or child has the right to file a wrongful death claim. The parents and siblings may file the claim if the deceased had no spouse or children. Possible damages you can seek following a fatal Woodland accident include:
- Lost income and benefits the deceased would have earned up until retirement, such as insurance and pension benefits.
- Expenses for funeral, burial, or cremation services.
- Reimbursement for the surviving spouse’s loss of affection and companionship.
- Compensation for the children’s loss of parental care and guidance.
- Claims for the loss of household services the deceased provided.
Rollover Accidents After Running Off the Road
Vehicles often veer off the road, resulting in a fatal Woodland accident. These incidents are frequently caused by driver error, such as speeding, but other factors may also play a role, such as:
- Hit-and-run or aggressive driving incidents: Aggressive drivers can cause crashes by hitting another vehicle or forcing it off the road, leading to a fatal accident. Attorneys can investigate to identify any other vehicles involved, ensuring the responsible driver is held accountable so the surviving family members can seek justice.
- Defective vehicle parts: A malfunction in a vehicle part can cause the driver to lose control, resulting in a fatal accident. With the assistance of an accident attorney, the deceased person’s family can file a product liability lawsuit against the auto manufacturer and the distribution chain.
- Poor road maintenance: Government agencies responsible for road upkeep can be held liable if accidents occur due to potholes, damaged guardrails, or other road hazards. Victims must file a claim against the government within six months, and legal assistance can improve their chances of success.
Your injury attorney can thoroughly investigate to establish fault and gather evidence for your compensation claim. Sometimes, several parties may be responsible for the accident, and each can be held liable for their part in your damages.
