What to Expect from the Wrongful Death Claims Process as a Surviving Family Member
Going through a situation where a close relative has lost their life in a car accident may be devastating and heartbreaking. The primary concern for surviving family members met with such a trying event is to get answers on what happened. When another party or entity is responsible for the loss of a close relative, surviving family members may be able to bring a wrongful death claim against the at-fault party for losses in connection to the loss. The damages available in a wrongful death case differ from those of a bodily injury claim. For instance, a survival action must be filed to recover the costs of medical treatment incurred before a loved one succumbed to their injuries.
Some of the economic and non-economic damages survivors may recover include loss of reasonably expected financial support, loss of companionship, funeral and burial service bills, mental anguish, lost services, and more. Punitive damages may also be sought if the fatal incident was the result of egregious actions like excessive speeding or DUI. When these are available, the sole intention of these damages is to hold the at-fault party accountable for their actions that led to a loss of life.
To recover financial compensation through a wrongful death action, establishing negligence in a fatal car accident may be challenging without the right assistance and collection of evidence. Fortunately, an experienced accident attorney may help in ensuring that surviving family members have all the relevant proof and records necessary for their case. A lawyer will also work diligently to make sure that survivors are not taken advantage of by the insurance company in their time of loss of grief by protecting their rights and best interests. What is the Filing Deadline for a Wrongful Death Claim in California?
A statute of limitations applies to lawsuits for fatal car accidents in California. This is a deadline that must be met for filing a case in civil court against the at-fault party. Under the California Code of Civil Procedure Section 335.1, a wrongful death suit must be filed no later than two years from the date of the fatal incident. If a case is not brought within this time frame, surviving family members may lose the right to recovery of financial compensation.
