Fortuna Fatal Motorcycle Crash on Highway 101
Fatal Motorcycle Crash Claims Two Lives Near Main Street
A fatal motorcycle crash in Fortuna, south of Eureka, on Highway 101 took the lives of two individuals over the weekend as the California Highway Patrol (CHP) continues its investigation. The incident unfolded just after noon on Sunday, November 10, when a 2007 Harley-Davidson, driven by a 41-year-old man with a 46-year-old woman as his passenger, lost control under uncertain circumstances. The motorcycle traveled north on Highway 101 with fellow riders when the crash occurred just south of Main Street.
Investigation Being Conducted Into Fatal Motorcycle Crash
Emergency responders promptly arrived at the scene. Both motorcycle riders had been ejected from the vehicle. The male driver was declared deceased there.
Both Rider and Female Passenger Die in Fatal Motorcycle Accident
The female passenger sustained severe injuries and was transported to St. Joseph Hospital in Eureka, where she tragically passed away. According to another rider who was with them at the time of the fatal crash, both were wearing helmets. The crash prompted a temporary closure of Highway 101 for approximately two hours while CHP traffic collision detectives conducted their investigation.
Who Can File a Wrongful Death Claim?
When negligence results in a fatal motorcycle crash, immediate family members, like the spouse and children, can file a wrongful death claim. This right extends to both biological and adopted children, as well as stepchildren who received at least half their support from the deceased. An executor may also file a claim, but only one claim is allowed. If immediate family members are unavailable, the deceased’s parents and siblings can file a claim, too.
Compensation in a Wrongful Death Claim
Several factors, including the deceased’s age and income, determine the compensation recoverable after a fatal motorcycle crash. Families may claim compensation in various areas:
- They can claim funeral, cremation and burial costs.
- They can recover the value of their wages and any benefits the decedent would have recovered through their working years.
- The spouse recovers compensation for their lost affection, love, and consortium.
- Children can claim compensation for the loss of nurturing and guidance.
- They may also claim the loss of household assistance.
