Can I Bring a Personal Injury Claim for a Car Accident in California?

Whether you are driving down Highway 4 or other roadways in Brentwood, catastrophic accidents and life-changing injuries in Brentwood may occur without warning. In addition to hospitalization and mounting medical expenses, which may result in lost earnings, you may have questions for a Brentwood personal injury attorney on your potential legal options for recovery.

California law provides injured parties the right to seek financial compensation for economic and non-economic damages related to a car accident injury if it was caused by someone else’s negligence. Because the personal injury claims process can be challenging and differs from case to case, the guidance of an experienced injury lawyer can be invaluable in securing compensatory damages for losses incurred.

How Long Do I Have to File a Personal Injury Lawsuit for a Traffic Collision?

According to the California Code of Civil Procedure Section 335.1, the statute of limitations for a personal injury case is two years. This means that claimants have two years from the date of a motor vehicle accident to file a personal injury lawsuit with the court or settle their claim with the insurance company. California does acknowledge some exceptions to this two-year statute of limitations. A Brentwood personal injury attorney from our law firm may evaluate your case to determine how it might be affected by specific filing deadlines. What Types of Compensation Can I Recover After Being Injured in a Brentwood Accident?

The amount of compensation a claimant may recover through a personal injury claim may vary based on the specific facts and circumstances of their case. What they may seek recovery for may remain consistent. When an injured party files a claim for compensation, they may seek recovery of economic and non-economic damages.

Economic damages are intended to compensate for financial losses related to suffering an injury in a Brentwood car accident. This may include medical expenses, lost wages, and property damage. Non-economic damages provide compensation for abstract losses like lost enjoyment of life, loss of consortium, and pain and suffering. Another type of damage that may be recovered for a car accident injury case is punitive damages. This type of damage differs from economic and non-economic damages in the sense that they are solely intended to punish the at-fault party for egregious conduct, like DUI or excessive speeding.

Since damages in a personal injury claim for a car accident are often challenging to prove, it is best to work with an experienced attorney. A lawyer who is experienced in handling car accident injury claims will know the best way to proceed in a particular case and provide the skills and resources it takes to secure fair compensation.
