A car accident in southeast Fresno claimed the life of one man and left two others injured on the night of February 17, 2019. The collision occurred shortly before 7:00 p.m. along Chestnut Avenue just south of Church Avenue. Officials responding to the scene found three vehicles, including a Jeep Cherokee that overturned in the crash. A preliminary report suggested that the Jeep was traveling with a Toyota sedan and a third vehicle when the collision occurred. Two passengers in the Jeep, both children, were transported to a local hospital for treatment of unspecified injuries. Their ages were not immediately available, but they were reported to be in good and stable condition by authorities. Sadly, one additional passenger in the Jeep succumbed to their injuries at the scene. Authorities have identified the decedent as 19-year-old Hector Sandoval of Los Angeles. Our deepest sympathies and condolences are with those grieving the loss of their loved one during this difficult time.
Accident Investigation
The exact cause of the car wreck is under investigation by the Fresno Police Department. However, the Toyota driver was arrested for driving under the influence. The motorist may face additional charges as the investigation continues.
Rollover Collisions and Roof Crush Fatalities
One of the deadliest of collisions today are those involving rollovers. These types of car accidents remain so deadly due to the roof of the vehicle crushing inward when overturning. In some cases, fatal injuries occur when the roof strikes the ground and crushes inward toward those within the vehicle. In other instances, the roof crushing also causes doors to open up or windows to break when the roof makes contact with the pavement. This can cause the roof to deform and create wide gaps for occupants to be ejected from the car. Since automakers are obligated to follow Federal Motor Vehicle Safety Standard Act (Part 216), they may be held financially responsible for a roof that fails to provide adequate protection in a rollover accident. Auto Accidents and Wrongful Death
No car ride should ever result in a loved one’s death. While the focus of family members of a decedent will be tending to emotional needs, other concerns must be taken into consideration in these types of cases. When a family member is lost due to wrongful death, the family of the deceased person may be left with many, unexpected expenses. In these situations, a wrongful death claim may be filed against the responsible party or entity for subsequent damages. This type of claim offers families a way to seek compensation for the financial and emotional hardship of their loved one’s death. To learn which family members are eligible to file for wrongful death, watch the below video.
What Can Be Recovered in a Wrongful Death Claim?
The types of damages that may be recovered in a wrongful death claim vary from case to case. Some of the most common include:
- Funeral and burial expenses
- Wages the deceased person would have earned in their employment had they lived
- Loss of moral support, love, attention, guidance, and community
- Household services made by the deceased to the household such as childcare or lawn maintenance
- Loss of inheritance
- Loss of benefits provided through a decedent’s job such as healthcare, pension, and other work-related wages
- Loss of consortium
