Garden Grove Double Fatality Crash
A Garden Grove double fatality crash occurred during the early morning hours of New Year’s Day. The incident happened shortly before 1:00 in the morning along the westbound lanes of the 22 Freeway in the vicinity of Valley View Street. A 30-year-old man from Orange was driving his BMW sedan at a high rate of speed when he rear-ended a Lexus traveling in the carpool lane. The impact of the collision propelled the Lexus into a concrete barrier along the right shoulder of the freeway. The BMW continued and struck a 2010 Ford F-150 truck, causing the truck to skid across traffic lanes and overturn onto its side. The BMW and the Ford later came to a rest after colliding with a guardrail. A driver of a Mazda sedan was unable to stop in time to avoid a collision with the overturned Ford and struck the center divider in the accident. Sadly, two occupants of the Ford succumbed to their injuries in the crash. Officials have identified the decedents as 33-year-old Jolene Gardner and her 9-year-old daughter, both residents of Hawthorne.
We would like to extend our sympathy to the friends and family of the mother and daughter who lost their lives in this devastating accident.
Investigation of the Garden Grove Double Fatality Crash
According to the California Highway Patrol (CHP), the BMW driver was arrested and booked on suspicion of gross vehicular manslaughter while intoxicated and driving under the influence. His bail has been set at $100,000 following the fatal car accident. A GoFundMe page has been established by the loved ones of Ms. Gardner and her daughter to cover their funeral expenses.
Rollover Accidents
Rollover accidents are considered the most dangerous types of motor vehicle collisions that occupants can experience. Injuries and deaths arising from such crashes are often due to the carelessness or negligence of a motorist. On other occasions, these collisions can be the direct result of defective manufacturing or design of a car, SUV or truck.
Crushed Roof Accidents
Roof crush resistance is the amount of weight a car’s roof can withstand to support and protect vehicle occupants. When this does not happen, one’s safety can be compromised if the roof collapses in or causes the doors and windows to buckle. This can lead to occupant ejection and result in serious injury or death in some extreme cases. Automakers are obligated to follow federal standards regarding vehicle roof manufacture and design. Passenger vehicle roofs must be able to support up to a minimum of 2.5 times the weight of the car. When this standard is not adhered to, an auto products liability claim may be filed against the vehicle manufacturer for damages incurred in a crushed roof accident. Since these cases are often difficult to navigate, consulting with an experienced injury attorney can help in discussing your legal options.
Liability in a Drunk Driving Accident
When a drunk driving accident occurs, liability for the incident may be assigned to more than one party. Depending on the circumstances of the crash, others who may be found responsible include the registered owner of the vehicle in which was provided to the intoxicated motorist and the business supplying liquor to the driver. While any motor vehicle accident runs the risk of causing serious injuries, those involving alcohol pose an even higher risk of injury or death. Moreover, those who have been injured or lost someone they love in an accident involving a drunk driver should contact an experienced personal injury lawyer in Sacramento for assistance.
Wrongful Death in a DUI Collision
The loss of someone you love is a heartbreaking experience that is compounded by the negligence of another driver causing that loss. This is especially true in cases of alcohol-related crashes which could have been completely avoided at the start. When a DUI collision results in the death of a loved one, surviving family members of the decedent may file a wrongful death claim to recover economic, non-economic, and punitive damages. To learn more about the types of recoverable damages, watch the following YouTube video. If you have questions regarding your case, reach out to an experienced Sacramento wrongful death attorney.
How a Wrongful Death Lawyer Can Help
After a loved one is lost to wrongful death, the family of the deceased may have the right to pursue compensation for resultant emotional and financial hardships. An experienced wrongful death lawyer can help in these cases by helping a family understand what occurred, who is liable, and whether compensation is available for the loss of a family member. While no amount of compensation can ever replace the loss of a loved one, bringing responsible parties to justice and being financially secure in the future can provide a sense of security and closure for the family.
