Accident on Foresthill Road Kills One Person and Injures Four

A head-on crash in Foresthill on July 12 killed a man and injured a mother and three children. The accident happened along Foresthill Road near Drivers Flat Road around 3:00 p.m., according to the California Highway Patrol (CHP). Foresthill is located northeast of Auburn.

Injured Woman and Three Children Transported to Hospital Following Head-On Crash

The Foresthill man who died, age 43, was in a Toyota Corolla heading west along Foresthill when the vehicle collided with a woman heading east in an Acura MDX that was carrying three children. The man was declared dead at the scene of the head-on crash. The Auburn Area Office of the CHP is attempting to determine fault in the accident, how fast the vehicles were going and whether drugs or alcohol factored into the fatal collision. The woman and children riding in the Acura were determined to have moderate injuries and were transported by ambulance to a nearby hospital.

Investigators Determining How Fatal Collision Occurred

Foresthill Road was shut down in both directions for over three hours while investigators worked to determine the cause of the crash. The roadway had reopened a little after 6:30 p.m. The name of the deceased driver will be released by the Placer County Coroner’s Office once the family is notified.

Causes of a Head-On Crash

Some of the most common causes of a head-on crash are:

  • Distracted driving: Talking or texting on the phone while driving is one of the most common causes of a head-on crash. This activity averts visual and cognitive attention off the road, leading to an accident.
  • Driving in the wrong direction: Reasons for this are mainly driver confusion and intoxication. However, the roadway directions and lane markings may be faulty. In this case, a claim can be placed against the city agency in charge of maintenance. Government claims must be filed within a shorter time frame (six months), beyond which the lawsuit will not be heard in court. Your car accident attorney will ensure that all paperwork is filed properly and in a timely manner.
  • Intoxicated driving: Drinking and driving is an unhealthy combination. Doing this causes you to lose cognitive skills as well as lowering reflexes. Intoxication is a leading cause of a head-on crash.
  • Excess fatigue: Driving fatigue is another major reason for a head-on crash. Drivers who close their eyes for even five seconds can easily drift into an oncoming lane, causing a head-on collision.

Defective Auto Parts in a Head-On Crash

A defective part can lead to a product liability lawsuit that targets the manufacturer. In California, there is no need to prove negligence. Rather, it is necessary to prove the item was used for the purpose it was intended for and to show that it was not modified by the driver. The vehicle should be retained by an accident attorney so investigators can review it for defects.

Compensation in a Crash

If someone dies in a collision caused by another’s negligence, the family can be compensated for their loss. In an accident of this type that results in injuries, the at-fault driver can be held liable for their actions. Some damages are:

  • In a wrongful death lawsuit, the family can be compensated for the loss of the decedent’s income from the time of the demise to their retirement age, funeral and burial expenses and other damages.
  • In a personal injury lawsuit, the following can be claimed:
    • Lost wages
    • Medical expenses
    • Rehabilitation and home modification due to their injury
    • Loss of enjoyment
    • Loss of social interactions
    • Anxiety and post-traumatic stress disorder

Determining Fault in a Head-On Crash

Our legal team and investigators determine fault to support the client’s claim for compensation. The investigators start by visiting the accident site and using accident reconstruction techniques and gathering surveillance camera video if possible. They interview witnesses and review police reports for mistakes. Our legal team then uses this information to build a robust lawsuit against the at-fault party.
