Driver Loses Control of His Vehicle on Moore Road

A single-vehicle accident fatality occurred on December 28 near Lincoln in Placer County, which reportedly involved the driver going at high speed. The accident fatality, according to the report issued by the California Highway Patrol (CHP), occurred along Moore Road close to Nelson Lane at about 9:45 p.m. The driver, in a Nissan Murano SUV, was going east along Moore Road when the vehicle exited the roadway, hit an embankment, and went airborne. When the Nissan landed on the ground, it rolled at least once and ended up on its roof.

Driver Dies in High-Speed Accident Fatality

The male driver was the sole occupant of the vehicle and was ejected during the accident. He was not using seat restraints at the time and suffered major injuries. Although the driver was transported to a hospital, he was declared deceased there.

Release of the Deceased Driver’s Name Pending Family Notification

The identity of the deceased man will not be released by the Placer County Coroner’s Office until his family has been notified. Although speeding appeared to contribute to the accident fatality, the use of alcohol or drugs has not been ruled out, and toxicology results are pending. Following the fatal crash, Moore Road remained closed near the crash site until sometime around 11:15 p.m.

Who Can File a Wrongful Death Claim?

When negligence by another driver or other entity causes the death of your loved one, the representative of the deceased’s estate or family may decide to file a wrongful death claim. While it cannot ease the grief they feel or their sense of loss, it can help the family avoid the financial stress caused by the absence of their family member and bring them a sense of comfort and closure that the responsible party is being held accountable. Members of the family who can join together to file a wrongful death claim include:

  • The spouse or putative spouse
  • Children in the family, including those who are natural, adopted, or stepchildren supported by the deceased by at least 50 percent
  • Children of a deceased child of the decedent can join in the wrongful death claim

What Can Be Recovered in a Wrongful Death Claim?

When a wrongful death claim is filed, the family members can decide how the recovered damages are distributed. The following is recoverable in wrongful death:

  • The surviving spouse can place a claim for the loss of consortium, comfort, and companionship the decedent provided.
  • The funeral and burial expenses are recoverable.
  • The income earned until retirement age by the decedent can be recovered, including pension benefits, bonuses, insurance coverage and others.
  • The family’s children can recover damages for the loss of guidance and nurturing that the decedent provided.
  • Loss of inheritance is recoverable, which is the amount the beneficiaries would have received had the decedent lived.
  • The loss of help provided by the decedent around the home can be recovered. This may include caring for the children, family autos, lawn care, tax preparation, and others.

A wrongful death lawyer cannot ease your pain from the loss of your loved one. However, the lawyer can handle your wrongful death claim, so you can face the future knowing that your family will be cared for financially.
