What is Wrongful Death?
In California, wrongful death occurs when an individual suffers fatal injuries as a result of an accident caused by another party’s negligence or carelessness. When a tragedy such as the one described above happens, the decedent’s surviving family members may be eligible to claim damages against the negligent party. In the context of a hit-and-run car accident, recovery may prove challenging, particularly if the fleeing motorist is not located by law enforcement. In these matters, it is helpful to work with an attorney that has the resources to track down a suspect driver with a private investigator.
Get the Justice and Financial Recovery Your Family Deserves
The unexpected loss of a loved one in a car accident may leave surviving family members with questions or concerns regarding financial hardship and intangible harm. Retaining legal counsel with experience handling fatal accident cases will help immensely in these situations. The right California wrongful death attorney will know the best way to proceed with building a strong case for full compensation on behalf of survivors. Eligible surviving family members may be compensated for lost earnings, funeral costs, medical expenses (through a survival action), loss of companionship, household services, etc.
The surviving spouse, domestic partner, or children of the deceased have the right and priority to file a lawsuit for wrongful death in civil court. In some cases, a surviving putative spouse, parent, stepchild, or other family member who relied on the deceased for support may be eligible for filing. There must be clear evidence proving that they were at least 50 percent financially dependent on the deceased. A skilled attorney can determine eligibility for filing based on the criteria set forth in CCP 377.60.
