Suspect Detained in Pedestrian Injury Accident on East Joiner Parkway

A suspect has been placed under arrest after fleeing after a pedestrian injury accident in Lincoln on August 10. The suspect, age 21, was taken into custody and charged with hit-and-run and DUI and booked into the Placer County Jail. The condition of the pedestrian has not been released.

Investigation Leads to Driver in Pedestrian Injury Accident

The accident occurred on East Joiner Parkway on the evening of August 10 when officers with the Lincoln Police Department responded to a call and found the injured pedestrian. The driver that struck the walker had fled the scene. However, investigators in the accident had a good description to follow up on. The suspect was located at a Rocklin home as well as the vehicle involved, which was towed for evidence.

Placing a Compensation Claim After a Pedestrian Accident

Pedestrians have the same rights and responsibilities as others using the roadway. When a negligent driver causes an accident injury, they can be held financially responsible. In this way, the injured walker can recover the money spent on their medical care, lost wages and be paid for their pain and suffering. We at AutoAccident.com have been successful many times in handling these types of compensation claims and can do the same for you. You are welcome to call for a free consultation.

Pedestrian Injuries and Driver Negligence

There are many ways that a motorist can be responsible for a pedestrian injury accident. Motorists are mentally programmed to watch for other drivers. It is common for a driver to say they never saw the pedestrian, bicycle rider or motorcyclist

Negligence plays a big role in accidents with pedestrians. Probably the most common reason for this type of traffic crash is when the driver runs a red light. However, other types of negligence that result in a pedestrian injury include:

  • The driver refuses to cede the right of way to a person crossing the street.
  • The motorist is distracted by texting, talking on a phone, or some other action that takes their eyes from the road.
  • Lighting in the intersection is poor, which makes it difficult for the driver to spot a walker. In these cases, the government entity in charge of design and maintenance may be liable.
  • The driver has been drinking or using drugs, which inhibits a motorist’s ability to drive safely.
  • The driver is too fatigued to be behind the wheel of a car. This can be caused by a medical condition such as sleep apnea, certain medicines, performing shift work, or just staying up too late.
  • The motorist is speeding and sees the pedestrian too late to stop without striking them.

Pedestrian Accident Investigations

Pedestrian accidents that result in injuries that are caused by a negligent person or entity require that evidence be gathered to prove the injured person’s claim. We send out our investigators to the pedestrian injury site to gather that evidence. Their investigations include checking for errors in the police report and interviewing witnesses.

Accident reconstruction is performed, and cameras in the area that might have caught the pedestrian injury on tape are sought. In addition, they look for signs of government negligence, such as a malfunctioning crossing signal, shrubbery that obscures the view and others. Once the evidence is gathered together, our lawyers use it for negotiating with the insurance carrier or preparing a strong court case.
