Does Auto Insurance Cover Losses in a Hit-and-Run Auto Accident?
A motor vehicle collision is an unexpected and stressful event, to say the least. When the motorist who caused the traffic crash leaves the scene without taking responsibility for their actions, it may make an already challenging situation even more difficult and frustrating. This is especially true if local law enforcement does not track down the at-fault party. Involved parties may feel like they have nowhere to turn for financial recovery. In these matters, retaining legal counsel experienced in handling hit-and-run crash cases is helpful.
When an experienced accident attorney represents an injured individual or the family of a deceased loved one, the lawyer will conduct their own investigation into the incident to hold the motorist accountable for their actions. The sooner an attorney is hired to handle the case, the more time they will have to investigate the incident and have a better chance of locating the suspect party. A lawyer will work quickly to gather and preserve evidence and hire a private investigator to track down the motorist who caused the crash and fled the scene.
Whenever possible, an attorney will do everything in their power to identify the vehicle owner and negligent driver behind a hit-and-run car accident. If not, a lawyer will work to identify other options for financial recovery in a hit-and-run accident case, such as uninsured motorist coverage. What is useful about UM coverage is that it may pay for economic and non-economic damages associated with a collision caused by a driver with no liability coverage. Moreover, it may also cover losses resulting from a hit-and-run auto accident.
Is There a Time Limit on Car Accident Cases?
A hit-and-run accident case requires ample time to investigate, prepare, and file in civil court. A lawsuit must be filed on time to protect the applicable statute of limitations. In California, that generally means within two years of an incident that caused bodily injury or wrongful death, according to CCP 335.1. The case may be dismissed if the matter is not settled with the other side and the lawsuit is not filed within the applicable deadline.
