What to Do After a Car Accident in California
When you are injured in a car accident, it is essential to receive medical treatment as soon as possible. As you begin to recover from your injuries, it is important to consider your legal options for filing a personal injury claim. There is a two-year statute of limitations that applies to personal injury cases brought in California. Before these claims may be filed, it is essential to gather the vital evidence needed to prove that it is well-founded. This includes traffic accident reports, photographs of the accident scene, eyewitness contact information and statements, medical bills and records, proof of lost income from employers, and other evidence relevant to your accident and losses incurred. It is essential to let your insurance company know that you were involved in a traffic collision as soon as possible. If you fail to do so, you may be denied the coverage that is available to you in your time of need, such as uninsured/underinsured motorist coverage (UM/UIM), collision coverage, and med-pay.
Types of Personal Injury Compensation
When a motor vehicle collision affects you and your family, you deserve to be compensated for the financial and intangible harms you have suffered and expected to suffer in the future. An experienced Tracy injury attorney can help build a personal injury case that shows your car crash would not have happened but for the negligence of the at-fault party. In addition to establishing liability and fault, an injury lawyer will also work diligently to prove the extent and value of your personal injury damages to negotiate a settlement with an insurance company for recovery of:
- Past and future medical treatment and expenses
- Lost income as a result of missing time at work to recover from car accident injuries
- Loss of consortium for accident injuries that have caused damage to a marital relationship
- Loss of future earning potential due to a permanent injury or disability suffered from a catastrophic motor vehicle crash
- Pain and suffering for the physical pain and emotional suffering an auto accident-related injury has had on a person and their life
- Punitive damages may be available in some personal injury accident cases if the conduct of the negligent driver was particularly egregious (e.g., DUI or excessive speeding)
Understanding how the personal injury claims process works for a car accident can be challenging, especially if this is the first time you have been injured in a crash. For a brief breakdown on these types of cases, watch the video below.
