Injuries Reported After Merced Pedestrian Accident
The California Highway Patrol (CHP) reported minor injuries after a pedestrian accident in the Merced area on May 22, 2020. The auto-pedestrian accident happened shortly before 11:00 a.m. on Golden Rule Avenue and North Winton Way. A green Volkswagen Jetta reportedly crashed into a pedestrian walking in the area, according to the CHP. The pedestrian suffered injuries described as minor. Information, including the sequence of events leading up to the collision and whether the pedestrian was hospitalized for their injuries, was not immediately available.
Common Types of Pedestrian Accident Injuries and Their Effects
Pedestrians who survive motor vehicle collisions are often left with serious injuries. Some may require months or even years of extensive rehabilitation before they can make a recovery, while others may suffer permanent trauma or disability. This is due to a pedestrian’s lack of physical protection when a vehicle strikes them. Drivers have airbags and seat belts, but pedestrians have nothing to protect them from harm’s way in a crash. Even a low-speed collision with a vehicle can cause a pedestrian to suffer some of the most catastrophic injuries on the spectrum. A few of the most common pedestrian accident injuries include internal trauma, crush injuries, amputations, spinal cord injuries, and traumatic brain injuries. Unfortunately, injuries such as these have the potential to change the ability of injured parties to return to their lives. Some may need to leave their employment to work in positions that best accommodate their injury. In other cases, some may not be able to work at all due to the severity of their injuries. Others may require lifetime care because of the accident. In situations like these, injured parties may seek financial recovery through a personal injury claim filed against negligent drivers and their insurance companies. However, specific factors may affect the value of these types of cases. To learn more, watch the video below.
Recovery of Injuries and Damages After a Merced Pedestrian Accident
California law requires evidence to support claims of negligence. This means that it is not enough to accuse a driver of careless or negligent driving. While a traffic citation for driving under the influence (DUI) or running a red light can help establish negligence, most personal injury cases are not that straightforward. Even in cases where liability is clear, the insurance company representing the at-fault party may find any detail to dispute the validity of a personal injury claim or its value as a whole. Fortunately, an experienced Merced personal injury attorney can help an injured pedestrian by proving the losses they have incurred as a result of the accident. This may include economic and noneconomic damages, like:
- Past and future medical treatment and expenses
- Lost wages
- Future loss of earning potential
- Mental trauma and emotional anguish caused by the pedestrian accident, such as post-traumatic stress disorder (PTSD) and anxiety
- Pain and suffering
- Permanent injury or disability
In cases where the other driver does not have enough insurance to cover the pedestrian’s injuries and losses, the injured party may seek recourse through their car insurance policy if they have underinsured motorist coverage (UIM). This type of insurance can help supplement any damages not fully paid by the other driver’s insurance company.
