According to the CHP, the crash involved a gray Kia and a blue Toyota Corolla. The Kia was located on the right-hand shoulder and the Toyota in the center divider. California Law on Liability and Damages in Car Accidents

Under California law, the individual or entity who causes a motor vehicle collision is financially responsible for injuries and losses associated with the incident. There is also a time limit an injured party must file a lawsuit against the at-fault party. This is known as the statute of limitations which is two years from the date of the car accident, as outlined in the California Code of Civil Procedure Section 335.1.

Working with an attorney is essential after an accident. For details on how to find the best lawyer to handle your personal injury case, watch the video below.

How an Attorney Can Help with Your Personal Injury Case

After a motor vehicle crash, you need answers to your questions and trusted legal guidance. Our law firm serves clients in Stanislaus County in several ways, including the following:

  • Listen to Your Story: Through a free consultation, our attorneys will speak with you to get an understanding of how your car accident happened, what types of injuries you suffered, and the best way to move forward with a claim for financial compensation. We will also address your questions, listen to your concerns, and have your best interests at heart. We will also advise you of what to expect as your personal injury case moves forward.
  • No Upfront Costs: At our personal injury law firm, we handle cases on a contingency fee basis. This means you will not have to pay any attorney’s fees unless we recover fair compensation on your behalf through a jury award or insurance settlement. This way, you can focus on recovering from your injuries instead of financial stress after a serious traffic collision.
  • Conduct an Independent Investigation: We will work with expert witnesses such as accident reconstruction experts to determine how the car crash happened and who should be held liable for damages incurred. Our attorneys will analyze whether driver negligence contributed to the incident and gather evidence to build your personal injury case.
  • Identify Potential Sources of Recovery: Our legal team will identify all applicable insurance coverages that may compensate injuries and damages incurred. California law requires vehicle owners to carry liability insurance that covers property damage and injuries to others.
  • Handle Paperwork: Our injury lawyers will file all necessary documents with the insurance company and civil court. We will ensure all filing criteria and deadlines are met in your case so it moves forward successfully.
  • Seek Full and Fair Compensation: We will prepare a demand letter and send it to the insurance company representing the at-fault party to ensure you are fairly compensated for your losses. To do so, we will negotiate.
  • Present the Case in Court: If the insurance carrier does not extend a fair settlement offer, our law firm will prepare a strong case to present in trial on your behalf.
