Things You Should Know About Car Accidents and Insurance Claims

After a motor vehicle collision, an injured party will need to file a bodily injury claim against the insurance company representing the negligent driver. This type of case seeks compensation for medical bills, wage loss, and other losses. However, insurance carriers do not always fairly compensate injured parties for accidents caused by their insured. The same may be said for first-party insurance claims for uninsured and underinsured motorist claims (UM and UIM) against negligent drivers with little to no bodily injury liability coverage.

What is most unfortunate and challenging is the claims process after a crash. An insurance company is a for-profit entity that has a vested interest in protecting its bottom line. Insurers often do so by disputing the value of bodily injury claims filed against their insured or even outright denying them. This is especially true for commercial insurance companies representing flatbed truck drivers.

When an insurance carrier resorts to defense tactics to dispute claims, it is essential for an injured party to speak with an experienced attorney who can conduct an evaluation of the case and determine potential options for financial recovery. What You Should Know About Personal Injury Law Procedures in California

Unless a claimant is familiar with the personal injury claims process in California, it is easy to make mistakes along the way that may impact the value or validity of their case. Like all states, California has strict filing rules that must be met when it comes to a bodily injury claim. These include:

  • Statute of Limitations: Under the California Code of Civil Procedure Section 335.1, a lawsuit must be filed within two years of a car accident. This deadline must be followed if a settlement is not accepted from the insurance company before the two-year statute of limitations expires.
  • Jurisdiction: A personal injury lawsuit must be filed in the appropriate civil court that has the legal authority to hear the case.
  • Inadequate Pleadings: In a complaint, the claimant is responsible for bringing a legal complaint against all at-fault parties.

A case may be dismissed by the court for failing to meet any filing criteria and deadlines. This has the potential to result in the loss of the right to recover damages. Rather than losing the right to the recovery of a financial award, it is critical to retain an attorney. A lawyer can help a claimant throughout the process to ensure they comply with personal injury laws in California.
