Lodi Area Accident Fatally Injures Three
I’m Ed Smith, a Lodi wrongful death lawyer. An auto accident occurred outside of Lodi toward the Delta during the morning of Tuesday, March 13, 2018. Sadly, the accident claimed the lives of three parties.
I would like to send my condolences to the family and friends of the three parties during their time of mourning and grief.
What Happened?
The California Highway Patrol (CHP) received witness statement reports of a black Nissan Murano traveling westbound along Highway 12 and overtaking slower moving vehicles across the double yellow lines when the driver lost control. The Nissan reportedly spun out and entered the eastbound lanes of travel in the direct path of a red Chrysler minivan. The driver of the Chrysler was unable to avoid the Nissan and broadsided the vehicle. The impact of the collision caused the Chrysler to travel down an embankment where it later came to a rest. The Nissan and the Chrysler both sustained major damage and resulted in airbag deployment as a result of the crash.
Nature of Injuries
An ambulance was called to the scene to assist the injured victims of the auto accident. A rear-seat passenger of the minivan, identified as a pregnant woman, suffered traumatic injuries and was transported to an area hospital for treatment. Officials have not yet released an update on her condition. The Chrysler driver was also taken to the hospital for treatment of life-threatening injuries but, unfortunately, passed away during hospitalization. Officials pronounced the Nissan driver and the front-seat passenger of the Chrysler deceased at the scene.
Identity of Victims
The San Joaquin County Coroner’s Office has identified the driver of the Nissan Murano as Christina Annette Rodgers, a 27-year-old woman from Stockton. The coroner has also identified the driver and passenger of the minivan as 82-year-old Anton William Sievers and 83-year-old Lareta Mae Sievers, both of Rio Vista.
Auto Accidents and Wrongful Death
When a loved one passes away, the family is oftentimes overwhelmed by the grief associated with the person’s loss. If a wrongful death is involved, the pain can be even worse. Sometimes the financial loss of an income provider can cause fear and anxiety. Those who are directly related to the deceased person may file a wrongful death claim to retrieve compensation for their losses. In order to file a lawsuit, the following elements must be satisfied:
- The death must be connected to an intentional or negligent act
- A link must be proven between an intentional or negligent act and the descendant
- Substantial evidence proving a financial impact on the surviving members of the decedent.
Filing such claims can be emotionally-draining and stressful without the assistance of a wrongful death lawyer in Lodi. Hiring an attorney with years of experience is crucial in protecting your right to fair restitution for your loved one’s death.
