Man Dies in Lodi Pedestrian Accident
A Lodi pedestrian accident on Sunday, April 2, claimed the life of a pedestrian. The Lodi Police Department is conducting an investigation as to the cause of the accident, and information on the victim has not yet been released to the public.
What Happened
At about 2:24 a.m., the man was struck by a vehicle close to the intersection of Lodi Avenue and Lower Sacramento Road. Police officers responded to the scene, where they found the severely injured man lying in the roadway. Although life-saving attempts were made, those efforts were futile, and the man was declared dead at the site of the accident. The driver of the vehicle who struck the pedestrian was not under the influence of drugs or alcohol. As a part of the ongoing investigation, the Lodi Police Department is asking anyone with information to call to determine if there were other vehicles involved in the deadly incident.
California Pedestrian Deaths
According to Smart Growth America, California ranks number 17 among states with the highest number of pedestrian fatalities. There were 6,616 pedestrian deaths reported in this state during the years 2005 to 2014. Areas in California with the highest numbers of pedestrian fatalities were Bakersfield, the Riverside-San Bernardino-Ontario area, Stockton-Lodi, Fresno, and Modesto. With this latest pedestrian death, Lodi had a total of seven pedestrians killed since 2004, with the highest concentration in the northeastern part of the city.
Recovering Damages From a Pedestrian Accident
Both drivers and pedestrians have a duty of care to act in a reasonable manner. Pedestrians should use crosswalks and avoid darting out or crossing between vehicles. Since a motor vehicle is capable of causing serious injury when involved in a pedestrian accident, a motorist must be alert for pedestrians. Right-of-way-violations are a major cause of accidents in California. These entail making sure a pedestrian has entered or exited the crosswalk before proceeding, speeding, not stopping at a traffic light, or turning illegally.
An individual who suffers injuries in a pedestrian accident may be entitled to file a personal injury lawsuit to recover the costs of medical care, lost time from work, and other expenses, even if the accident was partially the fault of the pedestrian. If a family member was killed in a pedestrian accident due to another person’s negligence, you may be able to file a wrongful death lawsuit to recover damages.
