Details on the SR-33 Head-On Collision That Claimed the Life of a Los Banos Man
CHP traffic officers said the head-on collision involved two trucks. Sadly, both truck drivers were pronounced deceased at the scene of the wreck. Details on what exactly led up to the incident were not immediately available as an investigation is ongoing.
The Fresno County Coroner’s Office has recently identified the decedents as 21-year-old Garrett Moore of Dos Palos and 34-year-old Emmanuel Espinoza of Los Banos. A GoFundMe page has been created on behalf of Mr. Moore and his family to help cover his final resting expenses.
What You Should Know About Fatal Crashes and Wrongful Death Claims
It is devastating to suddenly lose a loved one in a car accident. It is even more difficult to come to terms with when you realize that the crash was caused by the fault of another person or entity. Once you realize that another party’s negligence is behind your loss, you and your family will likely want justice. Fortunately, this may be done through a wrongful death claim filed against the at-fault party and their insurance company. This serves the purpose of holding the negligent party financially accountable for all the pain and losses they have caused you and your family.
There are several factors that must be considered before bringing a case against another individual or entity. The first is whether there is any evidence that suggests negligence. Another factor is whether you meet the filing criteria under the California Code of Civil Procedure Section 377.60. The spouse, domestic partner, and children generally have priority to filing a claim, followed by other close relatives if such family members are nonexistent. A two-year statute of limitations may also apply to wrongful death car accident cases. If you have questions about wrongful death actions, it is essential to reach out to an experienced attorney right away.
Speaking with a lawyer is the best way to learn about your rights and potential options for recovery after losing a loved one because of someone else’s recklessness or negligence. While it can be challenging to consider taking legal action while grieving, it is crucial to learn about the process as it is often not straightforward with insurance companies. Unfortunately, insurers do not have the best interests of surviving family members at heart after fatal car accidents. Insurance companies have teams of claims adjusters, investigators, and defense attorneys prepared to create defense strategies to devalue or deny claims survivors bring on behalf of their lost loved ones. Unlike insurance carriers, a Los Banos wrongful death attorney cares about surviving family members and will use their skills and resources to overcome challenges in these cases to obtain the compensation they rightfully deserve. Importance of Working with a Lawyer
A wrongful death case is often challenging and disputed due to the high stakes and damages involved for all parties. Therefore, it is essential for surviving family members to discuss their case with a lawyer before agreeing to sign any documents or accepting any settlement offers from the insurance carrier. Failing to do so may result in survivors losing out on the full extent of damages they may be entitled to. Contact our law firm today to learn how we can help you and your family through this difficult time.
