Madera Man Killed in Head-On Collision

Officials in Fresno County reported that a Madera man was killed in a head-on collision on Sunday, June 19, 2022. The crash on Father’s Day took place on Sunnyside Avenue and Ashlan Avenue near the Tarpey Village area at approximately 7:00 p.m.

Details on the Head-On Collision That Killed a Madera Man

A family of four was traveling together in a Nissan sedan on Ashlan Avenue, according to the California Highway Patrol. A driver of a black pickup truck allegedly veered into the oncoming traffic lane, where it collided head-on with the Nissan. Sadly, the Nissan driver, 41-year-old Ashton McKiearnan of Madera, was declared deceased at the scene of the car accident.

The wife of Mr. McKiearnan, also 41, was injured in the head-on collision. The children of the couple were described as a 1-year-old and a 2-year-old. Authorities reported that one of the children sustained serious injuries in the crash. The driver of the truck, a 35-year-old Parlier resident, was placed under arrest for felony driving under the influence following the incident, CHP traffic officers reported.

On June 21, 2022, the Fresno County District Attorney’s Office filed several felony charges against the DUI driver. These included driving on the wrong side of the road, causing significant bodily injury while impaired, DUI, and gross vehicular manslaughter. The DA’s office also indicated that the suspect may face 16 years in prison. Additional information on the incident has not yet been released by officials because of an ongoing investigation into the fatal car accident.

What Types of Damages are Available in a Wrongful Death Claim?

In a wrongful death case, a surviving spouse, domestic partner, children, or other family members that meet the criterion of the California Code of Civil Procedure Section 377.60 seek compensation for economic and non-economic damages. These may include loss of care and companionship, funeral and burial expenses, final medical expenses incurred because of the incident, lost future financial support, and more. In cases involving egregious behavior like DUI, the family may seek punitive damages from the at-fault party as a way of punishing them for their actions and deterring them from similar actions in the future.
