What Types of Damages Are Recoverable in a Car Accident Injury Case?

In a personal injury case for a motor vehicle collision, the injured party may seek reimbursement of economic and non-economic damages. Economic damages are quantifiable and based on actual financial losses in connection with the incident. They generally include lost wages, diminished earning potential, medical bills, property damage, and out-of-pocket expenses for losses in connection with the crash, like necessary home modifications for permanent injury or disability. Non-economic damages are subjective in nature and generally include pain and suffering, loss of enjoyment of life, emotional distress, etc.

In some cases, punitive damages may be awarded to the injured party. These are generally sought by the negligent individual or entity for particularly egregious or reckless behavior that led to the incident. Punitive damages are generally intended to deter similar behavior from the at-fault party and others in the future. In cases of personal injury for motor vehicle collisions, punitive damages may be awarded if the negligent motorist engaged in reckless behavior like excessive speeding or DUI. To ensure that you seek appropriate compensation for your losses, it is recommended to retain legal counsel right away.
