Head-On Collision on State Route 104 Results in Major Injury
A major injury occurred at around 6:47 a.m. along State Route 104 and McKinley Road in Wilton on February 10. The California Highway Patrol (CHP) reported that the injury was due to a two-vehicle head-on collision in the westbound lanes. Both lanes were blocked as tow trucks removed the vehicles, and the injured person was transported to a hospital for treatment. The roadway was reported as cleared at 8:00 a.m.
Head-on Collisions Can Lead to a Major Injury
Head-on collisions are among the most dangerous because the impact when the two vehicles crash together is doubled and often causes serious injuries. For example, two vehicles traveling at a low speed of 30 mph will hit each other with double the force. This is much like running into a concrete wall at highway speeds. So, it is no surprise that a major injury can occur.
Seat Belts and Air Bags
Seat belts have been shown to reduce the risk of a major injury or death in a head-on collision. However, a defect in the seat belt, such as in the strap or buckle, can make the restraint let go or tear. This can lead to injury as the driver or front-seat passenger strikes the windshield, steering wheel, or dash. In addition, airbags may not deploy properly or be defective, which can lead to a major injury. When seat belts or airbags do not function the way they are intended and lead to an injury, an auto products liability lawsuit may be filed against the manufacturer, distributor, and others.
Why Head-On Collisions Occur
There are many reasons a head-on collision occurs. Almost all of these types of crashes involve driver error. Some of the contributing factors in a head-on collision are:
- Passing on a two-lane road unsafely
- Drunk or drugged driving
- Distracted driving such as texting
- Fatigue
- A tire blow out or brake failure
- Speeding
- Making an improper turn
- Entering the wrong way on a street or highway
How a Lawyer Helps
A personal injury lawyer’s job is to help someone who was injured by negligence to obtain fair compensation to pay their lost wages, medical costs, and other expenses. This involves gathering evidence to support the client’s claim. Our investigators begin by looking for mistakes in the police report and interviewing witnesses to the major injury crash. They search for traffic surveillance cameras that caught the accident on tape and perform accident reconstruction. They also look for signs of government negligence, such as missing or obscured signs, potholes, and fissures in the pavement. When the evidence has all been gathered, it is given to our lawyers to build a strong case in favor of our client. It can be used in negotiating on the client’s behalf with the insurance company or in a civil court case.
