What to Expect from a Motorcycle Accident Injury Case?
Recovering full and fair compensation in a personal injury case for a motorcycle accident is not always straightforward, as there may be disputes associated with liability and damages resulting from the incident. There is a wide array of pitfalls that may affect a claimant and the value of their cases. A skilled Waterford personal injury lawyer may help an injured party obtain the fair compensation they need and deserve from the at-fault party. Some of the potentially liable parties in a motorcycle accident case may include:
- Hit-and-Run Driver: In an ideal situation, the driver of a vehicle involved in a crash with a motorcyclist would do the right thing by staying at the scene and rendering aid, if necessary. However, not all motorists do so and attempt to escape their liability for the incident, even if it means leaving an injured motorcyclist to endure the resulting consequences in their wake. Working with an experienced injury lawyer in such cases is essential as the attorney may work with a private investigator to track down the hit-and-run driver. In situations where the at-fault party cannot be located, the lawyer will work with the injured motorcyclist’s insurance company if they carry uninsured motorist (UM) coverage to cover damages resulting from the hit-and-run accident. Keep in mind that the motorcycle involved in the incident must be kept and preserved for an attorney and their team of experts to evaluate and determine whether the suspect vehicle made contact with the bike.
- Motorcycle Manufacturer: As a motorcycle rider, you expect your bike to operate as intended. However, there are some situations where a motorcycle may have faulty parts and equipment. If these are found to be contributing factors to an accident through clear and compelling evidence, an injured party may be compensated for damages incurred through an auto products liability claim against the manufacturer. Contact an experienced personal injury lawyer in Waterford for more details.
- Road Defect: As drivers, we expect our vehicles to travel on safe roadways. However, that is not always the case. Some roads in the state may present inherent dangers from unsafe design to lack of maintenance. Since government entities are responsible for the design and upkeep of public roadways, a claim may be brought against one if a road defect was a contributing factor to a motorcycle accident. Keep in mind that the statute of limitations is shorted from two years to six months in such cases. This is by the California Government Code Section 911.2.
