Off-Road Crash With Injuries at Payen Road Intersection
An off-road crash into a ditch occurred in White Rock near Folsom on September 18. A driver in a BMW slid off the roadway at Payen and White Rock roads around 1:38 p.m. into a ditch about 10 feet off the road for unknown reasons. The accident was transferred by the California Highway Patrol (CHP) to the Sacramento Metropolitan Fire Department.
Driver Hospitalized With Major Injury in Off-Road Crash
It was determined by medics that the driver had suffered major injuries in the accident. The injured party was taken to a hospital, while the car was towed. Investigators with the CHP traffic accident unit are in charge of determining the cause of the crash.
Outside Influences in an Off-Road Crash
Off-road accidents often occur as a result of driver fatigue, distraction, or other reasons, but sometimes they are caused by an outside force. Among the other causes of single-vehicle accidents are:
- Aggressive drivers: Often, accidents are caused by aggressive drivers in vehicles that flee the scene, turning it into a hit-and-run. No one else appears at the scene of the collision, making it appear to be a solo vehicle collision. An investigation into the accident may prove there was another vehicle involved that fled, and the accident occurred as a result. Evidence such as unmatching paint streaks, tire marks and metal can show that another driver was present at the time the collision occurred. When that driver is found, they can be held liable for accident injuries.
- Government roadway neglect: The failure of the government to ensure proper road maintenance may result in a serious off-road accident. Numerous factors can lead to a motor vehicle accident, including potholes, poor lighting, overgrown shrubbery, weak guardrails on a highway, and many others. It may be possible to hold government entities accountable for injuries or fatal accidents caused by their negligence. An injury lawyer may be able to help you ensure the deadline for filing a claim against a government entity is met, as the timeframe for filing claims against a government entity is shorter.
- Lost cargo obstructing the roadway: A road obstruction occurs when a piece of cargo falls off a truck or car and is not removed by the driver, causing an accident. The driver can be identified in these cases through an investigation, and they can be held accountable.
- When a vehicle is unable to be controlled by the driver due to an auto defect, such as a tire blowout or brake problems, an off-road crash can occur. The manufacturer, as well as others on the production line, can be held liable for injuries caused by a defective product. When filing an auto product liability claim, negligence does not have to be shown, only that the defective part was unaltered and used as intended.
