Common Reasons for Pedestrian Accidents in Merced

Pedestrian accidents in Merced typically occur due to driver negligence. Motorists are required to exercise caution anywhere a pedestrian can be found. Even though pedestrians sometimes show up in places where it is unexpected, drivers still owe them this duty of care. However, negligence by the driver is a common cause of a major injury pedestrian accident. This negligence can manifest in several ways, such as:

  • Distracted driving: Drivers who engage in activities like talking on a cell phone, texting, or daydreaming may divert their attention from the road, increasing the risk of hitting someone on foot and causing a major injury pedestrian accident.
  • Speeding: Speeding drivers have less time to react and may be unable to stop in time to avoid a collision with a pedestrian.
  • Driving under the influence: Intoxicated drivers may experience impaired reflexes and vision, making them more likely to crash into pedestrians.
  • Fatigue: Tired drivers exhibit many symptoms similar to those of intoxicated drivers, increasing their likelihood of making dangerous errors on the road.

Filing an Injury Claim Within the Statute of Limitations

In California, individuals who suffer a pedestrian injury in Atwater must file their claim within two years of the incident. It is advisable to consult with an injury lawyer promptly, as evidence may deteriorate over time, and witnesses might relocate.

Compensation for Pedestrian Injury Accidents

If a pedestrian is injured due to a negligent driver, they may be entitled to receive compensation for various losses, including:

  • Medical expenses: Costs associated with the accident, including hospitalization, ambulance services, diagnostic tests, surgeries, medications, and rehabilitation, can be recovered. Future medical expenses may also be included if the injury continues beyond settlement.
  • Lost wages: The injured party can claim compensation for lost income, which encompasses wages, tips, bonuses, and the value of benefits like insurance and pensions.
  • Pain and suffering: Those who have sustained injuries may be compensated for physical and emotional pain and suffering. This can include anxiety, nightmares, and recurring thoughts of the collision. Costs for professional treatment addressing emotional distress may also be recovered.
