Stockton Rollover Accident on S.R. 4 Causes Major Injury

A Stockton rollover accident resulting in injuries occurred on May 27 when a vehicle exited the roadway for unknown reasons. The collision occurred on westbound State Route 4 at Jack Tone Road around 9:56 a.m. The California Highway Patrol (CHP) reported that the vehicle was found off the side of the road.

Investigation Underway to Determine Cause of Stockton Rollover Accident

Nearby orchard workers were attempting to break the vehicle’s window to get to the injured person inside. A tow truck was called to the scene as well as an ambulance. It was determined the driver had suffered a major injury, and they were taken to a nearby hospital for treatment and additional evaluation. The CHP traffic accident unit is conducting an investigation to determine what happened to cause the collision.

Causes of Rollover Accidents and Resulting Injuries

A Stockton rollover accident is particularly hazardous and significantly increases the probability of severe injuries. The following actions can lead to a rollover:

  • Driver negligence: Losing control because of a distraction, speeding, drunk driving, or other behaviors frequently results in rollovers.
  • Collisions: Rear-end or side-impact collisions can spin a vehicle out of control, increasing the likelihood of a rollover.
  • Vehicle clipping: When one vehicle clips another, the second vehicle might crash into a guardrail or center divider, causing a rollover.
  • Road conditions: Poorly maintained roads with potholes or obstructions can lead to a rollover. While the responsible government entity can be held accountable, there is a six-month window to file a claim. An accident attorney can assist with paperwork and negotiations for the injured party.
  • Auto defects: Mechanical issues like faulty brakes or steering can trigger a rollover. Preserving the vehicle allows for an examination to determine if an auto defect caused the accident, enabling a claim against the manufacturer.

Roof Crush and Additional Injury Risks

The risk of roof collapse during a rollover adds to the potential for injuries. Auto manufacturers are legally obligated to design vehicle roofs and their supports to withstand rollover forces. However, not all comply with these standards. It is crucial to preserve the vehicle for a thorough inspection of any roof damage, which can serve as the basis for suing the manufacturer under auto product liability.

Legal Steps Following a Rollover Accident

Consulting an attorney immediately after a Stockton rollover accident can improve the chances of a favorable legal outcome. By filing a personal injury claim, individuals harmed by a negligent driver can recover medical expenses, lost wages, and compensation for pain and suffering. An attorney can ensure that all legal paperwork is completed accurately and submitted on time, provide support in negotiating settlements and pursue justice for the injured party.
