How Do Personal Injury Claims Work?
When a person is injured in a pedestrian accident caused by a negligent driver, that injured party may be able to file a personal injury claim for losses incurred. Compensation through these types of cases is intended to make an injured pedestrian whole after a catastrophic accident. This includes economic and noneconomic damages, such as:
- Costs of past and future necessary and reasonable medical treatment
- Loss of consortium for the damage a personal injury causes to a marital relationship
- Loss of future earning capacity if a pedestrian injury has caused a permanent limitation on a person’s ability to earn a living
- Lost wages for the time an employee misses at work to recover from an accident injury or attend a medical appointment
- Out of pocket expenses to accommodate a permanent disability suffered after a pedestrian accident, such as a wheelchair or brace
- Pain and suffering from mental distress and emotional trauma related to a personal injury

Is There Enough Insurance for a Central Fresno Pedestrian Accident?
Pedestrians who are struck by motor vehicles may suffer a wide array of injuries. Some of these injuries may be minor, while others may be more severe in nature. The most common types of injuries in pedestrian accidents include femur fractures, lacerations, traumatic brain injuries, and spinal cord injuries. Any of these injuries may require extensive medical care and time missed at work to recover from. When a pedestrian is injured in an accident with a driver who has little to no insurance coverage, this may put the injured pedestrian in a financial predicament. If the injured person has uninsured/underinsured motorist coverage on their car insurance policy, they may be able to be covered under that plan. If the injured pedestrian did not have car insurance at the time of the crash but lived with someone who has such coverage, they may be able to claim compensation under that policy so long as they are not listed as an excluded member.
How Long Do You Have to File a Claim for Personal Injury in California?
There is a filing process that injured pedestrians must follow to recover compensatory damages in California. It starts with bringing a personal injury claim within the statute of limitations, or the time limit in which a lawsuit must be filed. Under the California Code of Civil Procedure Section 335.1, a case must be filed within two years from the date of a pedestrian accident. If a case involves government entity negligence for a road defect, such as lack of street lighting or pedestrian crossings, a notice of claim must be filed within six months or 180 days from the time of the accident.
Do You Need a Fresno Personal Injury Attorney?
Insurance companies often take advantage of those injured in pedestrian accidents. Insurance claims adjusters may use defense tactics to convince injured pedestrians to accept low settlement offers. In other cases, they may find any way of disputing the value of a personal injury claim or denying it by pinpointing fault on the injured pedestrian. Handing over settlement negotiations to a Fresno personal injury lawyer may protect you from bad faith dealings with insurance companies. Your lawyer will handle communications with insurers on your behalf to allow the time you need to focus on recovering from your injuries.
