Man Injured After Motorcycle Accident in Clovis
A man on a motorcycle was injured after a motor vehicle accident in Clovis, CA, on the morning of May 2, 2020. The motorcycle accident occurred around 11:30 a.m. on eastbound Shaw Avenue between Dewitt Avenue and Minnewawa Avenue. Officers from the Clovis Police Department (Clovis PD) responded to the scene where they found a motorcycle rider unresponsive and a white Honda Accord with damage to the windshield and passenger side. According to Clovis PD, the motorcyclist was headed eastbound on Shaw Avenue when the driver of the Honda reportedly turned in front of him. The motorcycle rider was transported to Community Regional Medical Center in Fresno for treatment of serious injuries. Information, including the man’s condition and the cause of the crash, was not immediately available.
Who Is Responsible for a Clovis Motorcycle Accident?
Several parties may be financially responsible for a motorcycle accident and resulting injuries. First and foremost is the motorist of the other car. If that driver failed to exercise due care to the motorcycle rider, then the injured motorcyclist may file a personal injury claim against the other driver’s insurer. If poor road conditions contributed to the motorcycle crash or exacerbated injuries, then a case may be brought against the government entity responsible for maintaining the roadway.
Is There Enough Insurance?
When a motorcyclist suffers catastrophic injuries in a motor vehicle collision, the question of “is there enough insurance?” often comes to mind. When the other driver only carries state minimum insurance, there may be recourse for the motorcycle rider. This is possible if they have uninsured/underinsured motorist coverage (UM/UIM). Uninsured motorist coverage can help pay for injuries and losses caused by the at-fault party that has no insurance. It also covers damages in a hit and run. These personal injury damages include past and future medical expenses, lost wages, and pain and suffering. Similarly, underinsured motorist coverage can help supplement any losses not fully covered by the other driver’s insurance company. For a biker to be entitled to UM/UIM benefits, they must have higher policy limits than the other driver. What is the Statute of Limitations on Motorcycle Accident Injuries?
There is a two-year statute of limitations for a motorcycle injury claim in California. This means that a motorcycle rider has two years from the date of their injury to file a lawsuit. Since specific deadlines and criteria may apply in such cases, it is in the motorcyclist’s best interest to contact an injury lawyer as soon as possible after a crash. This way, the lawyer can build a strong case for fair compensation with the insurance company. If a fair settlement cannot be reached between the attorney and the insurer, then the lawyer can present the case in front of a judge and jury. The jury will decide whether the at-fault party is financially responsible for the accident and damages incurred. A jury will also determine the amount of financial compensation an injured biker is awarded for their emotional, physical, and financial hardship.
Why Should I Hire a Lawyer for a Motorcycle Crash?
People injured in motorcycle accidents often face months or even years of medical expenses for treatment and may be unable to work during that time. The last thing an injured biker would want to deal with is negotiating with insurance companies that may not even take into account how their injuries have impacted their life and the extent of losses incurred. By hiring an experienced Fresno motorcycle accident attorney, an injured motorcyclist can rest assured knowing their personal injury case is in good hands.
