Man Injured in Central Fresno DUI Crash

A man was injured and hospitalized after a central Fresno DUI crash on November 8, 2019. The car accident occurred shortly before 5:30 in the afternoon at the intersection of Millbrook Avenue and Belmont Avenue. A 53-year-old man was driving a GMC van in the area and reportedly ran a red light to make a left-hand turn, according to the Fresno Police Department. The GMC van then collided with a Honda Civic sedan. The impact of the collision caused the van to crash into a nearby building and overturn on its side. Officials said the driver of the GMC van attempted to flee the scene on foot, but he was later arrested on DUI charges. Sadly, the driver of the Honda was transported to the hospital for treatment of unspecified injuries. An update regarding his condition has not yet been released.

What to Do After a Central Fresno DUI Crash

After a car accident, negligence must be established on the part of the drunk driver when filing a personal injury claim for losses incurred. This may be done by collecting traffic collision reports and video surveillance from traffic cameras. Arrest records may also be used as a form of evidence against the negligent driver for DUI. Once this information has been collected, a Fresno auto accident attorney can use it to build a strong case for fair compensation on your behalf.

What Can Be Included in a Personal Injury Claim?

Compensation in a personal injury case consists of economic and noneconomic damages. Economic damages encompass the financial consequences an injured person has suffered, such as past and future medical expenses and past and future lost wages. Out of pocket expenses for medical appliances such as a wheelchair to accommodate a permanent injury or disability may also be covered under economic damages. For noneconomic damages, these take into consideration the intangible harms an injured party has faced. This includes scarring, disfigurement, and pain and suffering. Conversely, punitive damages may be awarded in cases involving egregious misconduct, such as a car accident caused by excessive speeding or drunk driving. Specific factors may affect the value of a personal injury claim. To learn what these are, watch the below video. If you have questions about your particular case, reach out to an experienced personal injury lawyer in Fresno.

How Long Do I Have to File a Personal Injury Claim?

There is a strict amount of time for which a claim for personal injury must be filed. This is known as the statute of limitations. Under the California Code of Civil Procedure Section 335.1, an injured person has two years from the date of the incident to file a personal injury case. If the deadline is not met, the case is likely to be dismissed by the court.

Do I Need a Lawyer After a Car Accident?

An experienced Fresno car accident lawyer understands how a serious injury may change an injured person’s life forever. Knowing what the needs will be for an injured person can help the attorney guide him or her along the path to social, occupational, and medical recovery. An injury lawyer is also there to ensure the injured person is fully compensated for their losses. If this has happened to you or a family member, do not hesitate to ask for help when it is needed.
