Loss of a Loved One

Losing someone you love is tragic and heartbreaking. When that loss is the result of another person’s negligence, it can be devastating for family members to know that their loved one’s death could have been prevented in the first place. Wrongful death is a legal term used to describe the life of a loved one taken away due to the negligent or careless actions of another. If you and your family have experienced the loss of someone you love in a traffic collision, it is essential to reach out to a seasoned wrongful death lawyer in Fresno as soon as possible. An attorney can explain what rights and options you and your family have for recovery.

Who Can File a Wrongful Death Claim for a Fresno County Car Accident?

A wrongful death claim is generally brought by the immediate family of the decedent after a fatal car accident. This includes a surviving spouse, domestic partner, or child. These claims are filed against negligent drivers and their insurance companies to obtain compensation to cover the financial support the decedent would have provided to the family. Other damages that may be claimed include:

  • Expenses related to a loved one’s death, such as funeral services and end of life medical treatment
  • Loss of a loved one’s care, companionship, and protection
  • Lost benefits, such as pension and health insurance, as a result of the wrongful death car accident
  • Mental anguish suffered by surviving family members of the decedent
  • Punitive damages may be recovered from negligent parties to punish them for their egregious actions and prevent them from causing harm to others in the future

Many factors may come into play when determining the losses survivors experience after the loss of a loved one. To learn how wrongful death claims work to cover these damages, watch the video below.

How Long Do I Have to File a Wrongful Death Suit?

When it comes to wrongful death cases, time is of the essence. In California, the statute of limitations on wrongful death claims is generally two years. This means that a lawsuit needs be filed no more than two years from the day of your loved one’s wrongful death. There are critical exceptions to this rule, so it is essential to discuss the facts of your case with an experienced Fresno wrongful death lawyer. The evidence necessary for proving a wrongful death claim can be lost over time, so it is crucial to speak with a lawyer as soon as possible.

How Can a Lawyer Help Our Family?

A wrongful death case often involves extensive damages and can be challenging to handle on your own. This is especially true when dealing with insurance companies and their team of defense lawyers who may dispute any detail of your case to pay as little as possible for your claim. At AutoAccident.com, we are here to help you and your family obtain fair compensation for the loss of your loved one. We can help by conducting an independent investigation of the fatal car accident, gather evidence to help support your wrongful death claim, and handle negotiations on your behalf. This way, you and your family can focus on what matters most during this challenging time, recovering from your loss.
