Details on the Pedestrian Accident on State Route 99 in Modesto
According to CHP traffic officers, a driver of a 1996 Acura Integra reportedly lost control of their vehicle, veered off the roadway, and into a ditch. The Acura was said to have overturned several times, and the driver was propelled from the vehicle onto the middle lane of Highway 99.
The Acura driver, believed to be a 32-year-old man from Stockton, was the sole occupant of the vehicle. Unfortunately, the Stockton man was struck by multiple vehicles, and the drivers allegedly failed to pull over to contact emergency personnel. Sadly, he succumbed to his injuries at the scene of the car crash. Further details on the rollover accident were not immediately available.
What You Should Know About Rollover Accidents and Auto Products Liability Claims
Roof crush may occur when a vehicle overturns in an accident. When the roof collapses, it may potentially create areas where vehicle occupants may be ejected through the windshield or window or crushing them. Due to the severity of such crashes, crushed roofs may result in catastrophic consequences for all parties.
A defect in the design or manufacturing of the vehicle may lead to roof crush in the event of a rollover accident. If this is the case, the automaker may be held financially accountable for damages incurred through an auto products liability claim. The reason behind this is vehicle manufacturers have a duty to ensure cars meet federal standards through proper testing and are deemed safe for consumers. It is essential for roof crush resistance testing to be conducted. This serves to ensure that the car roof is strong enough to withstand a force equivalent to at least 1.5 times the unloaded weight of the vehicle, as outlined in Federal Motor Vehicle Safety Standard (FMVSS) 216.
In general, a vehicle that meets such standard will crush less and decrease the risk of exacerbated injury or death of a vehicle occupant. Consult with an experienced Modesto personal injury lawyer immediately if you have suffered serious injuries or lost a loved one in a rollover accident. You may have grounds for an auto products liability claim. Keep in mind that the vehicle involved in the rollover must be preserved for an expert attorney to examine for potential defects. How an Attorney Can Help After a Wrongful Death Car Accident
Because of the nature of rollover accidents, they may potentially result in fatal injuries to those involved. If you lost a close relative in a crash involving a collapsed roof, you may be able to bring a wrongful death claim against the at-fault party. There is a two-year statute of limitations that applies to such claims and failing to meet this deadline, among others, may impact the case.
