Officials from the Sacramento Fire Department said that people from a nearby home came to the scene of the pedestrian accident with a jack and used it to lift the vehicle off the man. An inspector with the Sacramento Municipal Utility District arrived at the scene also to inspect the damage to a nearby electric pole. No information was released on whether alcohol or drugs played a part in the cause of the fatal collision.
Pedestrian Accidents Caused by Driver Error
Under California Vehicle Code 21960 VC, a driver is obligated to yield to a pedestrian in a crosswalk or at an intersection. However, under most circumstances, motorists must give pedestrians the right of way, and any type of negligence on the driver’s part will initiate a personal injury lawsuit. Some common examples of negligent motorist behavior are:
- Failure of the motorist to yield to the pedestrian: This is mandatory for drivers and applies to most situations.
- Running a red light: Passing through a red light catches a pedestrian walking through the intersection legally unaware and often leads to a pedestrian fatality accident or serious injury.
- Speeding: Driving over the speed limit is dangerous in a variety of ways. Other than hitting the pedestrian with a greater impact, speeding makes it difficult to stop in time to avoid an accident.
- Distracted driving: This reckless behavior is rapidly becoming the chief reason for traffic collisions and pedestrian accidents. Drivers who play with the radio or GPS and take their focus off the road are more likely to cause a pedestrian crash.
- Passing a stopped school bus with children exiting or boarding: California law states that drivers must stop a certain distance from a stopped school bus. When this rule is ignored, a pedestrian fatality accident can occur.
- Drunk drivers: An inebriated driver is frequently unable to control their vehicle or stop in time to avoid hitting a pedestrian.
- Hitting a driver exiting their vehicle on the side of the road: Often, drivers parallel parked along the road are hit by a passing vehicle when they exit their car.
