Manteca Woman Killed in Livermore Car Accident
A Manteca woman was killed after a car accident on Interstate 580 in Livermore, CA, on March 29, 2020. The crash happened around 6:21 a.m. on I-580 near Livermore Avenue. A 2004 Buick LeSabre was reportedly involved in a head-on collision with a 2014 Nissan Altima, according to the Dublin-Area California Highway Patrol (CHP) office. The driver of the Nissan, a 33-year-old Newark woman, was transported by ambulance to Eden Medical Center in Castro Valley for treatment of serious injuries. Sadly, the Buick driver was pronounced deceased at the scene by first responders. The Alameda County Coroner’s Office has identified the decedent as 24-year-old Gabriella Perez-Ramirez of Manteca. A GoFundMe page has been created on behalf of Ms. Perez-Ramirez’s family to help pay for her funeral expenses.
Loss of a Loved One
For many families, one of the most tragic things we can experience is the loss of a close relative before their time. Traumatic accidents and deaths can occur for a wide array of reasons, but the most challenging being a loved one’s death due to the carelessness or negligence of someone else. Grief is hard enough to cope with, especially when it comes to overwhelming frustration and anger. When this happens, you and your family may file a claim against the party responsible for your loss. While no amount of money can make up for the loss of someone you love, a wrongful death claim can help provide you with the justice and fair compensation to which you and your family are entitled.
Wrongful Death Damages in California
Insurance companies are not on your side when it comes to compensation for your wrongful death claim. They are businesses that are focused on their bottom line and will do anything to protect it. This includes disputing any fact of your claim to reduce its value. To receive the full and fair compensation your family deserves, you need an experienced Manteca wrongful death lawyer working for you. When claims move well beyond the negotiation process, you can depend on your lawyer to work with experts such as an accident reconstructionist and an economist to prove the true value of your case to a jury. At AutoAccident.com, our legal team can help you and your family recover damages for:
- Costs associated with a loved one’s unexpected death, such as accident-related medical treatment and funeral and burial services.
- Emotional and mental anguish resulting from the wrongful death of a close relative.
- Loss of future income and benefits for the family, like pension and health insurance.
- Lost care, companionship, and protection for survivors.
- Punitive damages may be recovered if a loved one’s death was caused by egregious actions on the part of the at-fault party. Keep in mind that punitive damages are not generally covered by insurance companies and are directly sought from negligent parties for their wrongdoing.
Who Can Bring a Wrongful Death Suit?
Under the California Code of Civil Procedure Section 377.60, only specific parties are allowed to file a wrongful death claim. This includes the decedent’s spouse, domestic partner, or child. The parents, stepchildren, and putative spouse of the deceased may be eligible to file for wrongful death so long as their loved one has no surviving spouse or child. Is There a Time Limit to File for Wrongful Death?
In California, a claim must be filed within a specific deadline known as the statute of limitations. For wrongful death, a lawsuit must be filed within two years of a loved one’s death. If a claim is not brought within the statutory deadline, the court will most likely dismiss the case, and the family may lose the right to recover compensation. This is why it is essential to work with an experienced wrongful death lawyer from Manteca. An attorney can work to ensure all filing criteria and deadlines are met in your case.
