I’m Ed Smith, a Modesto wrongful death lawyer. Sometimes, people keep drinking and driving despite being previously charged for driving under the influence (DUI). While some motorists learn from their mistakes, others are unable to quit their behavior and continue driving while intoxicated. A recent report stated that a man is facing multiple charges, including DUI, for the death of a police sergeant. This incident was not the man’s first DUI charge.
First DUI
Matthew David Gibbs was detained by the California Highway Patrol (CHP) in April 2012 on suspicion of drunk driving. The man’s blood alcohol content was allegedly three times the limit according to John Gould, a Stanislaus County District Attorney’s Office spokesman. The man failed to appear for his scheduled arraignment. A warrant was issued for his arrest, however, he was never detained. Gibbs hired an attorney to represent him on his DUI case.
In April 2014, Gibbs and his lawyer filed a motion to have his case dismissed due to the violation of Gibbs’ sixth amendment right to a speedy trial. Gibbs’ attorney argued that he had resided at the same address on record with the California Department of Motor Vehicles (DMV). The judge ruled in favor and dismissed Gibbs’ first DUI charge in September 2014.
Modesto Police Sergeant Matthew Gibbs Fatally Injured in Bicycle Accident
Michael Pershall, a 38-year-old sergeant for the Modesto Police Department, was riding his bike along Merle Avenue near Fine Avenue in Modesto. An oncoming Volkswagen coupe driven by Matthew Gibbs rear-ended Sergeant Pershall. The impact from the car propelled him off his bike. The vehicle continued until it struck a fire hydrant, west of the accident scene.
Emergency personnel arrived on scene to assist the injured victim. He was located along the roadway. Unfortunately, medics pronounced Sergeant Pershall deceased at the scene.
